Terms of Service (Allgemeine Geschäftsbedingungen)

1. Scope and Provider Information

These Terms of Service (hereinafter "Terms" or "AGB") govern all contractual relationships between:

(hereinafter referred to as the "Provider", "we", or "us") and the user of the StayLimitless application and services (hereinafter referred to as the "User" or "you").

2. Services & Platform Description

StayLimitless offers a digital book memory and learning system designed to help users retain key insights from nonfiction books without having to re-read hundreds of pages. The service includes:

• Daily Micro-Lessons: Curated and structured book summaries divided into 2–4 minute actionable reading chunks.
• Studio-Grade Audio Lessons: High-fidelity audio narration with native iOS background audio playback and Lock Screen player controls.
• Smart Delivery: Lessons delivered directly into your StayLimitless in-app inbox on your preferred reading schedule, accompanied by iOS push notifications and optional transactional emails.
• Library & Bestseller Catalog: Access to a library of over 10,000 bestseller titles and archetypes with WCAG-compliant cover visualizations.
• Interactive AI Book Advisor: Personalized book recommendations, contextual insights, and 6-day guided focus blueprints.
• Spaced Repetition & Action Prompts: Practical memory prompts to apply key frameworks into daily habits.

3. Account Registration & Access

To use StayLimitless, users create an account using their valid email address. Authentication is handled via passwordless 6-digit confirmation codes or authorized single sign-on (such as Google Sign-In).

• You agree to provide accurate and complete contact information and keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• The service is intended for individuals aged 16 and older. If you are under 18, you confirm you have parental or guardian consent to use the service.

4. Subscription Tiers & Billing

StayLimitless is available under two primary service tiers:

4.1 Free Tier

• Users can maintain up to two (2) concurrently active books in their library queue.
• Access to core reading chunks, sample 6-day blueprints, and standard inbox delivery.
• Limited AI advisor interactions (up to 5 initial trial queries).
• The Free Tier is provided free of monetary charge.

4.2 Limitless Subscription (Pro Tier)

• Unlimited Library: Save and actively manage unlimited books concurrently.
• Studio-Grade Audio: Full access to audio narrations for all active book chunks, including background audio playback and Lock Screen controls on iOS.
• Unlimited AI Advisor: Unlimited AI book suggestions, personalized multi-book blueprints, and deep-dive explanations.
• Flexible Pace: Customizable delivery frequencies (morning, evening, custom times) and chunk length customization.

5. In-App Purchases through the Apple App Store (iOS)

If you subscribe or purchase Limitless Pro through the StayLimitless iOS application, the transaction is processed via Apple's In-App Purchase system and is subject to the following terms pursuant to Apple App Store Review Guidelines:

• Subscription Titles & Duration: Limitless Monthly (1-month auto-renewable subscription) or Limitless Annual (12-month auto-renewable subscription). Current pricing is displayed in your local currency inside the app before purchase confirmation.
• Payment: Payment is charged directly to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours prior to the end of the current billing cycle.
• Renewal Billing: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the then-applicable renewal price.
• Managing Subscriptions: You can manage or cancel your subscription and turn off auto-renewal at any time in your iOS device settings (go to Settings > [Your Apple ID] > Subscriptions).
• Free Trials: If a free trial period is offered, any unused portion of the trial period will be forfeited when you purchase a subscription, where applicable.
• Refunds: All billing and refunds for purchases made through Apple In-App Purchase are administered directly by Apple in accordance with Apple Media Services Terms and Conditions (reportaproblem.apple.com).

6. Direct Web & Stripe Billing (Where Applicable)

If a subscription is concluded directly outside the App Store (e.g. via Stripe Payments Europe, Ltd.), payment is due in advance for each billing interval (monthly or annually). Subscriptions renew automatically unless cancelled prior to the end of the current period via the dashboard settings or by notifying us at [email protected].

7. Right of Withdrawal for EU Consumers (Widerrufsbelehrung)

If you are a consumer residing within the European Union (EU) or European Economic Area (EEA), you possess a statutory 14-day right of withdrawal from the conclusion of the contract, without specifying reasons.

Notice regarding digital content and instant activation: Pursuant to § 356(5) BGB, your right of withdrawal expires prematurely if we have begun execution of the contract after you have expressly agreed that we begin execution before the withdrawal period ends, and you acknowledged that you lose your right of withdrawal upon commencement.

8. User Content & Intellectual Property

• User Notes: You retain full ownership of any original text notes, personal summaries, or comments you enter into StayLimitless. By submitting notes, you grant the Provider a non-exclusive, worldwide, royalty-free license solely to store, process, and transmit this content to provide the service to you.
• StayLimitless Content: The application, user interface, proprietary book cover templates, audio narrations, text structuring, blueprints, and software code are the intellectual property of the Provider or its licensors and are protected by international copyright and trademark laws.
• Permitted Use: You may not copy, reverse-engineer, decompile, redistribute, resell, or scrape platform content or access our APIs via automated bots without prior written permission.

9. Artificial Intelligence (AI) Features & Disclaimer

StayLimitless utilizes advanced artificial intelligence (including models from Google, OpenAI, DeepSeek, and Groq) to analyze reading preferences, generate study prompts, and assist in book discovery.

• Educational Purpose: AI-generated suggestions, summaries, and book insights are intended solely for personal educational, cultural, and motivational micro-learning.
• No Professional Advice: Content provided by StayLimitless does not constitute professional medical, legal, financial, mental health, or investment advice. Always consult certified professionals for specialized guidance.
• Accuracy: While we endeavor to ensure high quality, AI outputs may occasionally contain inaccuracies. The Provider makes no warranties regarding the complete factual accuracy or exhaustive completeness of AI-generated summaries.

10. Availability & Service Continuity

The Provider endeavors to maintain an annual average platform availability of 99%. Excluded from this are periods of scheduled maintenance (which are kept minimal and off-peak where feasible) and service interruptions due to circumstances beyond the Provider's reasonable control (e.g., force majeure, third-party telecommunication failures, or upstream AI / cloud provider outages).

11. Limitation of Liability

In accordance with statutory German law:

1. The Provider is liable without limitation for damages caused intentionally or by gross negligence, as well as in the event of injury to life, body, or health, and under the German Product Liability Act (Produkthaftungsgesetz).
2. In cases of slight negligence, the Provider is only liable for breaches of essential contractual obligations (cardinal obligations / Kardinalpflichten)—obligations whose fulfillment is essential to the proper performance of the contract and upon which the user regularly relies. In such cases, liability is limited to typical, foreseeable damages at the time of contract conclusion.
3. Any further liability of the Provider is excluded.

For Users outside the EU / Warranty Disclaimer

TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, STAYLIMITLESS IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

12. Termination & Account Deletion

You may terminate your free account at any time by requesting deletion in the app settings or by contacting [email protected]. Upon deletion, your personal queue, library entries, and associated account data will be permanently purged in accordance with our Privacy Policy.

Termination of a paid subscription takes effect at the end of the current pre-paid billing cycle.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing in the EU, mandatory consumer protection statutory provisions of your country of habitual residence remain unaffected.
